Privacy Policy

Only In, LLC (“Only In” “we,” “us,” “our”) takes your privacy seriously and has designed this privacy policy (the “Privacy Policy”) to help you make informed decisions about your relationship with us. While you may be tempted to skim over some of this, we hope you’ll read it through carefully. We’ll do our best to help you understand everything so you can feel good about contributing to Only In.

We will not rent, sell or share your personal information with any other third party except as outlined in this Privacy Policy. By using the website located at www.onlyin.com and/or www.onlyin.com/newyork and/or www.onlyin.com/(other location name) (“Site”), you agree to the terms of this Privacy Policy. If you do not agree to these terms, please do not use the Site.

 

1.   Information We Collect

In order to offer you the best possible experience using the Site, we collect information about you as described below.

Information you provide

By using the Site, you may choose to provide information that could reasonably be used to contact you, or to identify you personally, or that otherwise relates to your person (such as your name, telephone number, email address, email preferences, and password for your Account (collectively, “Personal Information”)).  

When you use the Site, we may provide you with the option to supply us with additional demographic information such as your age, gender and zip code. If we combine demographic or other information we collect about you with Personal Information about you, we will treat the combined information as Personal Information. If you do not want your Personal Information collected, please do not submit it.

Information we automatically collect

When you use the Site or open one of our emails, we automatically record information about you using clear gifs or web beacons, cookies, and IP addresses. These terms are described in more detail below.

We may automatically collect the following information:

Information collected via technology

Cookies

A cookie is a small text file that is stored on a user's computer for record-keeping purposes. We may use cookies on the Site. We may link the information we store in cookies to any personally identifiable information you submit while on the Site.

We may use both session cookies and persistent cookies. Session cookies make it easier and safer for you to navigate our site. A session cookie will expire when you close your browser, you click the log out button, or if you have been inactive on our site for longer than 20 minutes. A persistent cookie remains on your hard drive for an extended period of time. You can remove persistent cookies by following directions provided in your Internet browser's "help" file. 

If you would prefer not to accept Cookies, most browsers will allow you to: (i) change your browser settings to notify you when you receive a Cookie, which lets you choose whether or not to accept it; (ii) disable existing Cookies; or (iii) set your browser to automatically reject any Cookies. If you reject cookies, you may still use our site, but your ability to use most areas of our Site will be limited. For example, you will not be able to log into your account if you reject cookies.

 

Web Beacons

We may employ a software technology called clear gifs (a.k.a. Web Beacons/Web Bugs), that will help us better manage content on our site by informing us what content is effective.  Clear gifs are tiny graphics with a unique identifier, similar in function to cookies, and are used to track the online movements of Web users.  In contrast to cookies, which are stored on a user's computer hard drive, clear gifs are embedded invisibly on Web pages and are about the size of the period at the end of this sentence.  If we use clear gifs, we will not tie the information gathered by clear gifs to our users’ personally identifiable information. 

We may use clear gifs in our HTML-based emails to let us know which emails have been opened by recipients.  This will allow us to gauge the effectiveness of certain communications and the effectiveness of our marketing campaigns.  If you would like to opt-out of these emails, please e-mail [email protected]

As is true of most Web sites, we use a third party tracking service to gather certain information automatically and store it in log files.  This information includes internet protocol (IP) addresses, browser type, internet service provider (ISP), referring/exit pages, operating system, date/time stamp, and clickstream data. 

We use this information, which does not identify individual users, to analyze trends, to administer the site, to track users' movements around the site and to gather demographic information about our user base as a whole.

  

2.   How We Use The Information Collected

We may use information we collect about and from you to: provide the Site to you - including allowing you to join the community and to enter contests, responding to requests that you make, improving the Site, and better tailoring content, advertisements, offers, the features, performance, and support of the Site; and for purposes disclosed at the time you provide your Personal Information or otherwise with your consent.  If you provide feedback to us, we may use and disclose such feedback for any purpose, provided we do not associate such feedback with your Personal Information. 

We may also use your personal and other information for any of the following purposes:

  • .  to monitor and conduct internal reviews of the Site;

You expressly agree that we may use your Personal Information to send you electronic newsletters or emails, unless you have requested not to receive such communications from us.  You can opt out of receiving further messages from us by following the unsubscribe instructions provided in emails you receive or by contacting us directly at [email protected].  We may also use your Personal Information to send you Site-related communications unless or until such time as you terminate your Account.

3.   When and With Whom We Share Your Information

Except as otherwise stated in this Privacy Policy, we do not trade, rent, or share your Personal Information with third parties, unless you ask or authorize us to do so.  We may share your information as disclosed at the time you provide your information, as set forth in this Privacy Policy and in the following circumstances:

Business Transfers. If our company or our assets related to this Privacy Policy are acquired by another  company, your Personal Information, and any other information that we have collected about the users of the Site, may be disclosed to that company as part of the due diligence process and will be transferred to that company as one of the transferred assets.  Should such a sale or transfer occur, we will use reasonable efforts to direct the transferee to use information you have provided through the Site in a manner that is consistent with this Privacy Policy.  Also, if any bankruptcy or reorganization proceeding is brought by or against us, all such information may be considered an asset of ours and as such may be sold or transferred to third parties.  

Law Enforcement Compliance. We may be required by law, or by law enforcement officers acting under the color of law, to record some or all of your communications on or through the Site.  We may, and you hereby authorize us to, disclose your Personal Information (including your Account Information) and your communications through the Site, if required by law or by law enforcement officers acting under the color of law, or if we believe in good faith that such disclosure is necessary to: (a) comply with relevant laws or to respond to subpoenas or warrants served on us; or (b) protect or defend the rights, property, or safety of Only In, you, other users, or third parties (especially in emergency situations).  

4.  Consent to Use of Information 

By using the Site, you agree to the terms of this Privacy Policy and you expressly consent to the use of your Personal Information according to this Privacy Policy.    

If you are a User who resides outside the United States, please be aware that information we collect is processed in the United States.  By using the Site, or providing us with any information, you consent to the collection, use, maintenance and transfer of such information in and to the United States and other applicable territories in which the privacy laws may not be as comprehensive as or equivalent to, those in the country where you reside and/or are a citizen. By using the site, you are agreeing to the application of this Privacy Policy to you, regardless of where you reside.

5.  Your Access and Choices

We offer you choices regarding the collection, use, and sharing of your Personal Information. When you receive communications from us, you may indicate a preference to stop receiving further communications from us and you will have the opportunity to “opt-out” by following the unsubscribe instructions provided in the email you receive or by contacting us directly at [email protected].  Only In does not charge for this service, and your opt-out request will be processed within 30 days of the date on which we receive it.  

Despite your indicated email preferences, we may send you administrative emails regarding the Site, including, for example, purchase confirmation, account creation confirmation, and notices of updates to our Terms & Conditions or Privacy Policy.

If you wish to verify, correct, update or delete any of the Personal Information provided to us, you may do so by editing it in your Profile and/or Settings pages, or by contacting us at [email protected].  In accordance with our routine record keeping, we may delete certain records that contain Personal Information you have submitted through the Site.  Please note that we may be required (by law or otherwise) to keep this information and not delete it (or to keep this information for a certain time, in which case we will comply with your deletion request only after we have fulfilled such requirements).  You should be aware that it is not always possible to completely remove or delete all of your information from our databases without some residual data remaining in our archives because of backups and other reasons. 

If you wish to withdraw or modify your consent to our collection, use or disclosure of the Personal Information provided to us, we reserve the right to terminate your Account or your continued use of the Site if the withdrawal or modification of your consent would or could adversely affect our operations or the Site.

6.  How We Protect Your Personal Information 

We take security seriously and take numerous precautions to protect the security of your information.  We follow generally accepted industry standards to protect the personal information submitted to us, both during transmission and once we receive it.  However, no method of transmission over the Internet, or method of electronic storage, is 100% secure.  Therefore, we cannot guarantee its absolute security.

7.  Email Communications

We may send you information regarding your account activity, as well as updates about our contests and other promotions.  You cannot opt-out of administrative emails, which relate to a user's activity on the Site, and include emails regarding a particular user's account, requests or inquiries, communications regarding contests you have entered through the Site, and important account activity.  

By agreeing to this privacy policy you consent to receive any such communications. If you do not wish to receive them, you have the option to unsubscribe and/or deactivate your account. 

8.   Protecting Children's Privacy

Protecting the privacy of children is especially important to us. Our Site, including our contests, are not intended for use by children under the age of 13.  As such, we do not knowingly or intentionally collect personal information from children under 13 on our Site. 9.  Deactivating Your Account

If you wish to cancel your account or request that we no longer use your information to provide you services you may delete your account or send an email to [email protected].  We will retain and use your information as necessary to comply with our legal obligations, resolve disputes and enforce our agreements.

10.  Changes to Our Privacy Policy

We may make periodic changes to this Privacy Policy, so please review it frequently. The date last revised will always appear at the top of the Policy.  If any change in our Privacy Policy relates to the way we use your information, we will notify you via email and post a prominent notice on the Site before using your information in a materially different manner than claimed when your information was collected by us.  These notifications will take place 14 days prior to changes taking place.
